Terms of Service

These terms are adapted for the Easy Fax website/web app and should be reviewed by legal counsel before launch.
1. Definitions
1.1 “Terms” refers to the latest version of these terms of service.
1.2 “We/Us/Site/Platform/App” refers to the Easy Fax website or mobile applications, available at https://www.easyfaxapp.co.
1.3 “User/You” refers to any person visiting, using, or otherwise interacting with the platform, site, or app or its materials.
1.4 “Privacy policy” refers to the privacy policy governing the collection, use, and storage of information provided by the user, available on the site.
1.5 “Outside sources” refers to any application, website, natural or legal entity other than Easy Fax.
1.6 “Materials” refers to all images, text, audio, video, or other data located on the app and the site, or originating from them.
1.7 “Services” refers to all services offered through the platform, app, or site, including sending and receiving faxes and obtaining fax phone numbers.
2. General Provisions
2.1 These terms govern the use of the app, the site, the platform, and materials.
2.2 The terms apply to all users regardless of capacity, purpose, or instruments used to access the app, the site, or materials.
2.3 By accessing the app or the site you confirm that you have read, understood, and agreed to be bound by these terms, the privacy policy, and applicable laws. If you do not agree, you may not use the app, the site, or the platform.
2.4 If you do not comply with the terms, we reserve the right to suspend or terminate your access to the app, the site, services, or your account, at our sole discretion and without prior notice. We reserve the right to deny services to anyone at any time.
2.5 These terms, together with the privacy policy, represent a legally binding agreement between you and us.
3. Consent
3.1 By accessing the site you confirm that you are at least 18 years of age, or of the age of legal consent in your jurisdiction with a guardian present. We may request satisfactory proof of age, identity, and guardian capacity.
3.2 By using our services you confirm that you (i) have full legal capacity to enter into a binding relation; (ii) will provide true, accurate, and complete information where requested; (iii) have the funds necessary for the requested service; and (iv) will not use the services contrary to these terms or applicable laws.
4. Changing Our Terms
4.1 We may update these terms periodically. The current version is available on the site with its effective date; users are encouraged to review the terms periodically.
4.2 Users are bound by changes to the terms once published and available for review.
5. Licence, Ownership and Rules of Conduct
5.1 Subject to your compliance with these terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to use the app and the site. You may not copy, modify, or create derivative works; distribute, sublicense, lease, or rent the app or site; or reverse engineer, decompile, or disassemble them.
5.2 All content on the app and site is the property of Easy Fax and protected by applicable law. You must obtain our written permission to use materials for commercial purposes.
5.3 Users are forbidden to misuse the services. We may suspend or stop providing the service if we find or suspect misuse contrary to these terms, the privacy policy, or applicable laws.
5.4 Any unauthorized use is prohibited. You agree to abide by all applicable laws and are solely responsible for activity under your account. You agree not to use the service for unsolicited or bulk faxes (“fax blasting”), spam, harvesting numbers, impersonation, transmitting unlawful, infringing, or harmful content or malware, or attempting to gain unauthorized access to the service or other systems. Sending unsolicited fax advertisements is illegal in the United States, the European Union, and other jurisdictions and will result in termination.
5.5 You do not own any telephone number assigned to you by the platform; such numbers remain the property of the platform, which assigns temporary number(s) for your use during the term, unless you subscribe to an inbound fax number.
5.6 You will not harvest, collect, or keep a record of numbers owned by the platform, including temporary numbers assigned to you, nor send faxes to numbers owned by the platform in violation of this agreement.
6. Registration, Services and Billing
(A) Registration
6.1 Some functionality is available only to registered users. You agree to provide true, accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your account and for all activity under it.
6.2 You agree to notify us immediately of any unauthorized use of your account. While we provide encryption to protect certain information, you understand that faxes may be intercepted and that you remain solely responsible for the content of your faxes.
(B) Services
6.3 The full list of services and pricing is available on the platform. We may change prices and plans at any time; changes are effective upon publishing.
6.4 Easy Fax offers a platform to send and receive faxes.
(C) Sending Faxes
6.5 To send faxes you subscribe to one of the sending plans on the platform.
(D) Receiving Faxes
6.6 To receive faxes you subscribe to an inbound fax number, which allows receiving faxes during the subscription period.
6.7 We may, as a promotion in some locations, offer a free trial for inbound faxing. Any unused portion of a free trial is forfeited upon purchase of a subscription.
6.8 Subscriptions automatically renew unless auto-renew is turned off before the end of the current period. Your payment method will be charged for renewal at the then-current price. You can manage and cancel your subscription as described in Section 7.
(E) Fax Storage
6.9 While your account is active, faxes received on your inbound numbers are stored and displayed in your account. We may change storage practices and limits at any time, and have no liability for the storage, deletion of, or failure to store any messages.
(F) Billing
6.10 Payments for purchases made on the website are processed by Stripe, our third-party payment processor. Card details are entered on and handled by Stripe; we do not store your full card information. By purchasing, you also agree to Stripe’s applicable terms.
6.11 We may, at our discretion, limit or refuse a service or order — for example where billing information is incorrect or invalid, where we cannot process payment, where we suspect fraud, or pursuant to a prior payment dispute.
7. Cancellation and Refunds
7.1 You may cancel your subscription at any time from your account settings or by contacting support at support@easyfaxapp.co. Cancellation takes effect at the end of the then-current billing period, and you retain access until then.
7.2 Except as required by law or granted by Easy Fax in its sole discretion, fees already paid are non-refundable. Easy Fax reserves the right to refuse or cancel purchases at any time in its sole discretion.
8. Acceptable Use Policy
8.1 We may review usage to determine compliance with this policy and these terms, and may limit or terminate access for violations.
8.2 Unreasonable use includes, without limitation: autodialing, fax blasting, bulk faxing, telemarketing, or broadcasting a single document to many fax numbers at once.
9. Confidential Information
9.1 You agree to protect any confidential and proprietary information you access through the service using a reasonable degree of care.
9.2 You agree that a breach of these confidentiality provisions would cause irreparable harm for which we may seek injunctive relief in addition to other remedies.
10. Third-Party Content
10.1 We may provide content or links belonging to outside sources. We are not responsible for outside sources, which are not under our control and may have their own terms and policies.
11. Privacy
11.1 Please review our Privacy Policy to learn how we collect and use information about you via the service.
12. Governing Law
12.1 These Terms are governed by and construed in accordance with the laws of the State of Illinois, without resort to its conflict-of-law provisions. The parties consent to the exclusive jurisdiction of the state and federal courts located in Cook County, Illinois.
12.2 Easy Fax is not responsible for any failure or delay attributable to causes beyond its reasonable control, including acts of God, civil disturbances, disruption of telecommunications or power, interruption of service by providers, the Internet, labor disturbances, computer viruses, or unlawful acts of third parties.
13. Indemnity
13.1 You will indemnify and hold harmless Easy Fax and its employees from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your access to or use of the site and services, content you provide, or your violation of these terms.
14. Statute of Limitations
14.1 Any claim or cause of action arising out of or related to the use of the app, the site, services, or the terms must be filed within fifteen (15) days after it arose, or be forever barred.
15. Disclaimer
15.1 To the fullest extent permitted by law, the app, the site, and services are provided “as is” without warranty of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, or non-infringement. We are not liable for any direct, incidental, consequential, indirect, or punitive damages arising from your use of or inability to use the service or materials.
16. Final Provisions
16.1 If any part of these terms is found invalid, illegal, or unenforceable, the remainder of the terms remains in effect.
